Subject:- Policy for grant of NOC for running Diploma/Certificate Courses in the field of disability.

The matter regarding framing of policy for grant of No objection Certificate to the Non Govt. organisations for running Diploma/Certificate Courses relating to the disabilities under Rehabilitation Council of India Act, 1992 was under consideration of the Govt. for quite some time. Now the State Govt. has framed a ploicy for issuing No objection certificates which is annexed herewith.
2. It is requested that this policy may be kept in view while recommending the proposals of the N.G.Os to the State Govt. for issuing N.O.C.

ANNEXURE-A
Policy for grant of NOC for running Diploma/Certificate Courses in the field of disability
1. The institution applying for NOC for starting such courses shall submit the details about the registration of the Society alongwith the activities undertaken by it since inception, rented building and its financial position, Income Tax returns etc.
2. The institution shall create its own website which should be indicated in the application itself.
3. After the receipt of the application, a Committee to be constituted by Commissioner Social Welfare whould inspect the infrastructural and other facilities available with the applicant society for running such a course. The said Committee shall include an expert in the field of Rehabiliation of children with special needs.
4. The inspection report of the Committee would be put up to the State Government to grant NOC in principle.
5. After the grant of NOC in principle, the applicant institution will be asked to submit a bank guarantee of Rs.12.5 lacs from any Public Sector Bank in favour of the Government so that the same can be enforced if the society violates any terms and conditions of the NOC.
6. The applicant institution must satisfy the accommodation, other infrastructural including hostel facilities as per the norms fixed by the RCI.
7. The State Government will be competent to prescribe the fee structure
and no donations will be taken from the students/trainees.There shall be no exploitation of the trainees.
8. The institution shall employ only qualified staff having qualifications as
prescribed by the RCI and as per its norms.
9. The institution will submit an affidavit that it will not seek any assistance
from the State Government. However, it shall be eligible for any Government of India assistance without any matching contribution from the State Govt.
10. The syllabi/curriculum of these courses would be as prescribed by the RCI.
11. The in-take capacity of the trinees/students will also be restricted as per
the norms prescribed by RCI which is normally 20 students in one course.
12. The institute will have its own land or land on lease for atleast for a
period of 20 years under an irrevocable lease.
13. Such institutions should employ the non-technical staff only from Haryana
State.
14. The size of the class rooms and other physical facilities should be as per
RCI norms.
15. Employability of the trainees passing out of such institutions would also
have to be kept in view so that they do not remain unemployed for long.
16. State Government will be free to impose any condition as it deems fit from time to time in the public interest.
17. State government may withdraw the NOC at any time and without giving any notice if deemed fit in the public interest.

In partial modification of this Department letter No. 9036-80/H3/HW/SJE/07, dated 5/4/2007 on the subject noted above, it is hereby intimated that the Government has decided to relax Conditions No.1 and 5 as follows:-
1- Condition No.1 The Institutions and Societies being run even in the rented buildings would also be covered under the Scheme.
2- Condition No.5 The amount of bank guarantee from any Public Sector Bank in favour of the Government has been reduced from Rs.25 lacs to Rs.12.5. lacs.
